These Terms of Service (“Terms”) govern your use of www.bessiebae.com (the “Site”) and your purchase of products (“Products”) from Bessie Bae Ltd (“we”, “us”, “our”). By using the Site or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to purchase from our Site. By placing an order, you confirm that the information you provide is accurate and complete.

2. Our Contract with You

When you place an order, you will receive an email acknowledging receipt. This does not mean your order has been accepted.
A contract is formed only when we send a confirmation email stating that your order has been dispatched.
We may refuse or cancel an order at our discretion (for example, due to stock unavailability, pricing errors, or suspected fraud).

3. Pricing and Payment

Prices are shown in GBP (£) and include VAT where applicable.
If you order from outside the UK, your bank or payment provider may apply exchange rates and additional fees.
Payment must be made in full at the time of ordering using the methods available at checkout.

4. Delivery

Delivery options, costs and timeframes are provided on our Shipping & Returns page.
We are not responsible for delays outside our control (such as postal strikes or customs clearance).
Risk passes to you upon delivery. Title passes once we receive full payment.
International customers are responsible for any customs duties or import taxes.

5. Returns and Refunds

Our Shipping & Returns Policy forms part of these Terms. Please review it for information on returns, exclusions and refund rights.

6. Warranty

Our Products are covered by a 6-month warranty against manufacturing defects. See our Jewellery Warranty for details.
The warranty does not cover normal wear and tear, loss, accidental damage, misuse or alterations made by third parties.
Warranty claims must be submitted via our Contact Us page and include proof of purchase.

7. Product Information

We aim to ensure product details, measurements and images are accurate, but minor variations may occur due to the handcrafted nature of our jewellery.
Colours may appear differently on different screens or devices.
As items are handmade, slight variations should be expected and are not considered faults.

8. Gemstone & Symbolism Disclaimer

Any references to the healing, spiritual or symbolic qualities of gemstones or semi-precious stones are based on historical and cultural beliefs and are provided for general interest only.
They do not constitute medical advice and should not be relied upon for diagnosis or treatment. Always seek guidance from a qualified healthcare professional for medical concerns.

9. Intellectual Property

All content on the Site (including text, logos, images and product designs) is the property of Bessie Bae Ltd or our licensors and is protected by intellectual property laws.
You may not copy, reproduce or use any content without prior written permission.

10. Limitation of Liability

To the fullest extent permitted by law, our total liability for any loss or damage arising out of or in connection with your order is limited to the price paid for the Product(s).
We are not liable for indirect, incidental, or consequential losses, or for events beyond our reasonable control.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any rights you have as a consumer under UK law.

11. Privacy and Data Protection

We process personal data in accordance with our Privacy Policy and applicable UK data protection laws (UK GDPR and the Data Protection Act 2018).

12. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

We may update these Terms from time to time. The version published on the Site at the time you place an order will apply to that purchase.

14. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining sections remain in full effect.
